Tricoci Rewards Program

Effective Date: December 26, 2023

OVERVIEW

Please read the full Terms and Conditions below carefully. By becoming a member of the Tricoci Rewards program, you agree to these Terms and Conditions. If you do not agree, do not join. Subject to these Terms and Conditions, Members can earn points on the amounts they spend on qualifying products and services at tricoci.com and all Tricoci Salon & Spa locations. Points are not awarded for amounts paid for tips and gratuities, rewards redemptions, shipping charges, gift cards, memberships/series, cancellation/no-show fees, returned and/or refunded purchases, and all taxes, including without limitation, federal, state, and local taxes or use taxes.

Mario Tricoci Hair Salons & Day Spas, LLC d/b/a Tricoci Salon & Spa (Tricoci) reserves the right to modify or terminate the Tricoci Rewards program, including changing or terminating the number and type of benefits offered to members of Tricoci Rewards, in its sole discretion at any time, with or without notice.

Notice About Dispute Resolution: These Terms & Conditions contain provisions on binding arbitration of disputes on an individual basis which will be binding on you unless you opt out as described in the Arbitration Section VI below.

I. Members

1. Enrollment

No purchase is necessary to enroll in the Tricoci Rewards program. The Tricoci Rewards program is intended for personal use only. Commercial use is prohibited.  New member enrollment for Tricoci Rewards is closed.

2. Eligibility

Members must be age 18 years or older and a resident of the United States to be become a member. Membership is limited to individuals only and is limited to one account per individual. Members must be opted-in to email marketing Tricoci or they forfeit the right to receive offers, promotions, and special offers.  Triocci employees are not eligible to participate.

3. Account

Program accounts are not transferable and are not for sale, resale, or barter. Tricoci is not responsible for any unauthorized use of a member’s account or unauthorized redemption of a member’s points. It is the Members’ responsibility to manage access to or redemption of points by family, friends, or other individuals who might have access to the Member’s account.

4. Member Cancellation

A member may cancel their Tricoci Rewards membership at any time. Upon cancellation, any unused points accrued in your account will be forfeited and cannot be redeemed.

II. TIERS

1. Enhanced

The first tier (Enhanced) is achieved upon enrollment in Tricoci Rewards. Enhanced members  earn 0.65 points for every full $1.00 spent on eligible products and services.

2. Elevated

The second tier (Elevated) is achieved when a member spends between $700 and $1,599 in eligible purchases in a single calendar year. Status for initial entry into the tier is maintained for the remainder of the calendar year in which it is earned through December 31 of the following calendar year (minimum of twelve months, maximum of 24 months). For example, if a member reaches Elevated status in July 2022, their status is valid until December 31, 2023. Once the allotted time is awarded, the guest will need to maintain the minimum spend each calendar year to continue in the tier, otherwise they will be dropped to the tier lower. Elevated Members earn 0.85 points for every full $1 dollar spent on eligible products and services

3. Empowered

The third tier (Empowered) is achieved when a member spends $1,600 or more in eligible purchases in a single calendar year. Status for initial entry into the tier is valid for the remainder of the calendar year in which it is earned through December 31 of the following calendar year (minimum of twelve months, maximum of 24 months). Once the allotted time is awarded, the guest will need to maintain the minimum spend each calendar year to continue in the tier, otherwise they will be dropped to the tier lower. Empowered Members earn 1.00 point for every full $1 dollar spent on eligible products and services

III. EARNING POINTS

1. General

Members can earn Tricoci Rewards points on qualifying purchases on tricoci.com and at all Tricoci Salon & Spa locations. Points are not awarded for amounts paid for tips and gratuities, rewards redemptions, shipping charges, gift cards, memberships/series, cancellation/no-show fees, returned and/or refunded purchases, and all taxes, including without limitation, federal, state, and local taxes or use taxes.

2. Earning Rate

Members earn a minimum of 0.65 points for every full one dollar ($1) spent on the purchase of qualifying products or services on tricoci.com and at all Tricoci Salon & Spa locations. Purchase amounts are rounded down to nearest full $1 increment. For example, if a member spends $19.99, points will be awarded based on a $19 transaction.  

Elevated Member Points. Elevated members earn 0.85 points for every full $1 dollar spent on eligible products and services, as described above.

Empowered Member Points. Empowered members earn 1 point for every full $1 dollar spent on eligible products and services

3. Gift Cards

Members are rewarded Tricoci Rewards points on qualified purchases paid for with a Tricoci gift card. Members do not earn points on the purchase of gift cards.

4. Timing of the Addition of Points to Accounts

Points are generally posted to a member’s account within twenty-four (24) hours of a qualifying purchase and may take up to two weeks.

5. Exclusions

Tricoci Rewards points are not awarded on amounts paid for tips and gratuities, Rewards redemptions, shipping charges, the purchase of gift cards, memberships or series, or any taxes including, without limitation, federal, state, and local taxes or use taxes. We reserve the right to modify the earning eligibility of any product or service at any time, at our discretion.  Redemption of merchandise vouchers, and any type of price adjustments, including merchandise returns, are not eligible for points. Purchases made prior to a member’s enrollment are not eligible for Program credit, except when enrolled while making a points-eligible purchase.

6. Returns

Points earned on a purchase that is later returned, refunded, or otherwise credited or reversed, will be deducted from the Member's account in an amount equal to the points earned for the original transaction. If a member does not have sufficient amount of points, their account will go into a negative balance. If points were applied to the original transaction, these will be refunded to your Rewards account. Any remaining refund will be issued to the Member’s original form of payment. 

7. Extra Point Promotions

From time to time, Tricoci may run special promotions in which Members may earn extra points for completed actions and/or purchases. These promotions are subject to the terms and conditions of that offer, along with these Terms and Conditions, and may be offered at any time at Tricoci’s sole discretion.

8. Points Disputes

If you believe that points have not posted to your Account within two weeks of a qualifying purchase ("Points Dispute"), please notify us immediately. We will use reasonable efforts to investigate your Points Dispute so long as you notify us of such dispute within ninety (90) days of the purchase. If you do not notify us within such ninety (90)-day period, you will have waived your right to make a Points Dispute with respect to that purchase. In order for us to undertake an investigation of your Points Dispute, we may require you to provide written confirmation of the dispute. If we do not receive the requested written confirmation at the address and within the time requested by us, we may, at our sole discretion, determine not to investigate your Points Dispute. Upon completion of our investigation of your Points Dispute, we will have no further responsibilities should you later reassert the same Points Dispute.

9. Points Expiration

Points expire six (6) months from the date the points were earned beginning on January 1st, 2024. Previously earned points earned on or before December 31st, 2023 will expire per the original 12-month period from the date at which they were earned. No credit or cash will be issued for unused or expired points. 

IV. REDEEMING POINTS

1. General

Points earned by a member may be redeemed for products, services or discounted products and services at a minimum of 400 points. Points cannot be redeemed for purchasing a Gift Card, Gift Card Packages, Tricoci Wellness Club memberships or Series. Points may not be used to pay for tips/gratuities or taxes.

2. Points towards services and products

Members can use their points to reduce the purchase price of a qualifying service and/or qualifying product free of charge based on the following scale:

  • 400 points = $5.00 off
  • 800 points = $10.00 off
  • 1200 points = $15.00 off
  • 1600 points = $20.00 off
3. Redemption In-Salon

Members must indicate if they wish to redeem points prior to completing their transaction. We are unable to retroactively apply points to a completed transaction. Members may redeem a maximum of 1600 points ($20) per calendar day.

4. Gift Cards

Points cannot be used towards the purchase of gift cards.

5. Exclusion

Points accumulated on different Accounts by different Members may not be combined or aggregated to make purchases of products and services or for any other reason. Points earned in a transaction cannot be redeemed in the same transaction.

V. GENERAL

By joining the Tricoci Rewards program, you agree to be bound by these Terms and Conditions set forth in these program rules. Tricoci reserves the right to cancel, modify, or restrict Tricoci Rewards or any aspect of the program, including, without limitation, the point conversion ratio and the point expiration policy at any time. Any changes can be made without advance notice.  Tricoci may make these changes even though such changes may affect the Member's ability to use points already accumulated. You are responsible for remaining knowledgeable about the program Terms and Conditions. Tricoci reserves the right to determine the amount of points in any Member's account based on Tricoci's internal records related to such Member's account. In the event that there is an inconsistency between the amount accrued in a member’s account and the Member's receipt and Tricoci's internal records, notify the rewards service team to evaluate. Tricoci assumes no responsibility for errors caused by incorrect member information. The sale of points is prohibited and may result in the confiscation or cancellation of your points as well as suspension or termination of your membership, which in each case shall be final and conclusive. Tricoci may revoke any Member's membership in Tricoci Rewards at any time if such Member engages in abuse of the program or fails to follow the Terms and Conditions of the program. Fraud or abuse relating to the accrual of points or redemption of rewards may result in revocation of membership in the program and may affect a member’s eligibility for participation in any other Tricoci program. Tricoci Rewards points are non-transferable and cannot be redeemed for cash. The interpretation and application of the program's Terms and Conditions are at the sole discretion and determination of Tricoci. 

Without notice to you, Tricoci also reserves the right to "unregister" and make ineligible any Tricoci Rewards account that has been inactive for one (1) consecutive year. Inactivity is defined as not making a valid purchase of products or services on tricoci.com or in any Tricoci Salon & Spa locations for a period of 12 months. In the event that your account is unregistered or rendered inactive, all accrued points in your account are void.

 VI. ARBITRATION AGREEMENT; RIGHT TO OPT OUT.

Please Read This Section Carefully – It May Significantly Affect Your Legal Rights, Including Your Right to File a Lawsuit in Court.

1. Initial Dispute Resolution. We are available at rewards@tricoci.com to help address any concerns you may have regarding the Services. Most concerns may be quickly resolved in this manner.  Member and Tricoci agree to use best efforts to settle any disputes disagreement directly through consultation and good faith negotiations which shall be a precondition to either party initiating a lawsuit or arbitration. 

2. Agreement to Binding Arbitration. If the parties do not reach an agreed upon solution within a period of thirty (30) days from the time informal dispute resolution is pursued pursuant to Section V(A) above, then either party may initiate binding arbitration. All claims arising out of or relating to these Terms and Conditions (including their formation, performance and breach), the parties’ relationship with each other and/or Tricoci’s provision of the Tricoci Rewards program shall be finally settled by binding individual arbitration administered on a confidential basis by JAMS, in accordance with the JAMS Streamlined Arbitration Rules and Procedures, excluding any rules or procedures governing or permitting class arbitration. Each party will have the right to use legal counsel in connection with arbitration at its own expense. The parties shall select a single neutral arbitrator in accordance with the JAMS Streamlined Arbitration Rules and Procedures. The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability or formation of these Terms and Conditions, including, but not limited to, any claim that all or any part of these Terms and Conditions is void or voidable. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity. The arbitrator’s award shall be in writing and provide a statement of the essential findings and conclusions, shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction. The interpretation and enforcement of these Terms and Conditions shall be subject to the Federal Arbitration Act.

The JAMS rules governing the arbitration may be accessed at https://www.jamsadr.com/adrrules-procedures. If Member initiates arbitration, to the extent the filing fee for the arbitration exceeds Two Hundred and Fifty U.S. Dollars ($250.00), Tricoci will pay the additional cost. If Tricoci is required to pay the additional cost of the filing fees, Member should submit a request for payment of fees to JAMS along with Member’s form for initiating the arbitration, and Tricoci will make arrangements to pay all necessary fees directly to JAMS. Tricoci will also be responsible for paying all other arbitration costs arising in connection with the arbitration.  Member will not be required to pay fees and costs incurred by Tricoci if Member does not prevail in arbitration. 

The parties understand that, absent this mandatory provision, they would have the right to sue in court and have a jury trial. They further understand that, in some instances, the costs of arbitration could exceed the costs of litigation and the right to discovery may be more limited in arbitration than in court. 

3. Class Action and Class Arbitration Waiver. Member and Tricoci each further agree that any arbitration shall be conducted in their respective individual capacities only and not as a class action or other representative action, and Member and Tricoci each expressly waive their rights to file a class action or seek relief on a class basis. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then the arbitration provision set forth above in Section 8(B) shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

4. Exception - Small Claims Court Claims. Notwithstanding the parties’ agreement to resolve all disputes through arbitration, either party may seek relief in a small claims court for disputes or claims within the scope of that court’s jurisdiction. 

5. 30 Day Right to Opt Out. Member has the right to opt-out and not be bound by the arbitration and class action waiver provisions set forth in Sections V(B), (C), and (D) by sending written notice of Member’s decision to opt-out to the following address: rewards@tricoci.com. The notice must be sent within thirty (30) days of enrolling as Member in the Tricoci Rewards program, otherwise Member will be bound to arbitrate disputes in accordance with the terms of those sections. If Member opts out of these arbitration provisions, Tricoci also will not be bound by them.  

6. Exclusive Venue for Litigation. To the extent that the arbitration provisions set forth in Section V(B) do not apply, the parties agree that any litigation between them shall be filed exclusively in state or federal courts located in Chicago, Illinois (except for small claims court actions which may be brought in the county where you reside). The parties expressly consent to exclusive jurisdiction in Chicago, Illinois for any applicable litigation other than small claims court actions.
